Be Active Privacy Policy

Be Active North Carolina, Inc (“Be Active”) is committed to respecting the individual privacy of all participants using the Be Active website (the “Site”).  This Privacy Policy describes our information gathering and dissemination practices for the Site.  It does not apply to information collected by us off-line.

By registering with the Site and accepting our Terms of Service, you agree to the terms of this Privacy Policy.  If you do not agree with the terms of this Privacy Policy, do not register with Be Active or use the Site.

1.   Collection and Use of Information

Personal information includes information that identifies you as an individual, such as your name, email or physical address.  In order to view the Site, you do not have to provide any personal information; however, in order to use the Site, you must register and provide certain personal information in connection with such registration.

Non-personal Information is information which cannot identify you as an individual, such as browser logs, your IP address, operating system, Internet service provider, navigational data (such as time spent on a page) and the like.   Certain non-personal information is automatically gathered when you access or use the Site.  Non-personal information may also include information which is gathered and collected by us, but is not linked with your personal information and does not enable identification or contact with you and may include aggregate and statistical data regarding how the Site is used.

We gather both Personal and non-personal information about our users.

A.   Account/Registration Information.  When you register with the Site, we require you to provide us with your personal information, including as applicable, your name and e-mail address. You may be able to provide additional personal information when establishing your personal profile.  We will use such information to fulfill your service requests, provide the services associated with the Site, such as sending you daily activity reminders, recommendations for physical activity events in your area and the like.  We may also use such information to and notify you about changes to the Site, new functionality or services or special promotions or offers from us.   We may use personally identifiable information to provide You the services offered under the Site and to communicate with You regarding Your physical activities and participation in the Site, including recommending certain activities based on your personal preferences or information such as geographic location or activity preferences, or sending reminders to You regarding daily activities.

B.   Anonymous Information and preferences.  You understand that Be Active may collect, aggregate, analyze and use non-personally identifiable or anonymized information regarding Your use of the Site and level of physical activity, including county of residence, gender, age group and similar information which shall not be linked to Your personally identifiable information (such as your name or email).   Be Active may use such non-personally identifiable information to improve the functionality, appearance or usability of the Site, to improve Be Active’s current service offerings or to create new ones, to create white papers regarding use of the Site or to issue usage reports to its donor groups. This information may also be analyzed and/or aggregated to determine appropriate modification and enhancements to the Site or to customize the user experience.

C.   Collection of usage data.  We may collect and analyze information about your use of the Site for the purposes of determining your compliance with our Terms of Service and this Privacy Policy.

D.   Use of IP Addresses.  We may use your IP address to help diagnose problems with our servers and to administer the Site. Your IP address is used with the IP addresses of other members to gather broad demographic information.

E.    Use of Cookies.  Please be aware that we or our business partners may use “cookies.” Cookies are pieces of information that a Web site places on an individual’s hard drive for record-keeping purpose and/or to enhance a user’s experience. You may adjust your hardware to disallow the storing of cookies. However, you may not be able to access your Profile or dashboard or Team pages or use other aspects of the Site if cookies are disabled. We are not responsible for the use of cookies by other Web sites that are accessed through us.

2.   Other Use and Disclosure of Information

In addition to the use of information explained above, we may also:

(a)   Disclose your personal information to companies who work on behalf of or with Be Active to provide the Site or other information, products or services to you that you have requested. We require that any such companies agree to use personal information of our users solely for the purpose of performing the services for us.

(b)   Release personal information and/or other information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state, federal or international laws or respond to a court order, subpoena, or search warrant.

(c)   Disclose personal information and/or other information about you that we believe, in good faith, is appropriate or necessary to enforce our agreements, take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Site, and protect the rights, property, or personal safety of Be Active our users or others.

3.   Sharing

You may be able to select certain sharing functions of the Site that would allow other users of the Site to access or view Your Profile and other information.  If you select such functions You understand and agree that Your information may be accessible to other users of the Site.

4.   Use by Minors

Children aged 13 and under not register or use the Site.  If you are 13 years old or under, please do not register for or use the Site and you should not provide any personal information on or through the Site.  We do not knowingly collect information from children aged 13 and under.  If you are a parent and suspect that your minor child has provided us with personal information, please contact us at info@beactivenc.org.  We will promptly take steps to delete such personal information.

5.   Choice/Opt-Out.

From time to time, we may request your consent or notify you about Be Active’s other programs, ongoing promotions or marketing efforts.  In such event, we will provide you the opportunity to opt-out of such notifications, promotions or marketing efforts or from receiving certain communications from us.    Even if you opt out of such mailings, however, we reserve the right to send you e-mail and other communications to disclose maintenance and other service-related issues.

6.  Information Correction/Updates.

You may access, update and/or correct your account information at any time by clicking on “My Profile” when logged into your account.  You may need to supply certain information so that we can try to verify that you have authority to modify this information.

7.     Third-Party Sites.

The Site may contain links to other Internet sites. We have no responsibility for the privacy practices of other Web sites, including the Web sites of our business partners.  You should review the privacy policies of any sites that are linked to our Site for more information on their practices prior to providing personal information to such site.

8.     Sale of Company or Assets.

In the event that all or part of Be Active is acquired by or merged with a third party entity, you agree that we may transfer or assign the information we have collected from you as part of such merger, acquisition, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used.

9.     Security.

We have implemented reasonable security measures on the Site to help protect against the loss, misuse and alteration of the personal information under our control.  However, you acknowledge and agree that there is always some risk involved in transmitting and posting personal information over the Internet and that some persons may circumvent our security processes and systems.  As a result, we cannot guarantee that your information or photographs will be absolutely secure.

10.  Changes and updates to this Privacy Policy.

This Privacy Policy may be revised periodically by Be Active as reflected by the “last modified” date below. Please revisit this page to stay aware of any changes.  We will use reasonable efforts to notify you of material amendments to this Privacy Policy by posting a notice on the Site.  Your continued use of the Site constitutes your agreement to this Privacy Policy and any future revisions.
